TERMS AND CONDITIONS FOR ACCEPTANCE OF ADVERTISEMENTS.

1. Boys Toys (UK) Ltd ("The Publishers") reserves the right to refuse publication of any advertisement without notice or explanation. In these terms the word "Advertiser" shall be construed to include any person or organisation placing an advertisement on behalf of another.

2. Guarantee of insertion cannot be given and the Publishers shall not be liable for any loss or damage caused by any error or inaccuracy in the printing of an advertisement or by the total or partial failure (however caused) of publication or distribution of any publication in which an advertisement is scheduled to appear. In no case shall the total liability of the Publisher for any misprint, error or emission exceed the price charged by the publisher for that advertisement.

3. Advertisements will be accepted only on the express condition that the Advertiser warrants that the advertisement does not in any way contravene any existing legislation and in particular the Trade Descriptions Act, 1968, and the Consumers Credit Act, 1974.

4. Claims for any error or inaccuracy in the printing of an advertisement must be made within 10 days of publication to the accounts department.

5. No liability is accepted for any loss or damage alleged to have arisen through delay in forwarding replies to Box numbers, however caused, nor for the loss or damage to any artwork supplied.

6. Advertisers are requested to check their advertisements after the first insertion. The Publishers will not be responsible for any errors or subsequent insertions which have not been advised to them in writing.

7. Cancellation must be advised in writing, 6 weeks prior to date of copy deadline date.

8. All rates quoted are subject to VAT at the rate currently in force at the time the advertisement appears.

9. Should the rate for advertisements be altered the price for remaining insertions shall be revised accordingly or the Publishers shall have the right to cancel the unexpired portion of the order.

10. Unless agreed otherwise in writing by the Publishers the terms of payment for credit accounts are 28 days net from date of invoice.

11. Any discount which the Publisher may have agreed with the Advertiser shall be forfeited in the event of failure by the Advertiser to meet the above credit terms.

12. In the event that the publisher closes a customer’s account, for what ever reason, the account must be settled immediately.

13. Advertising agency commission will be allowed to those Advertisers recognised by PPA but shall not exceed 10 per cent and will be subject to the terms of that recognition. The commission will not be allowed if the advertising agency fails to meet the agreed credit terms.

14. The Advertiser agrees to indemnity both the Publisher in respect of all costs, damages or other charges falling upon The Publisher or any of the companies within The Group as the result of legal action or threatened legal action arising from the publication of the advertisement

15. The placing of an order for an advertisement shall amount to acceptance of these Terms and Conditions and any condition placed on an order by an Advertiser shall be null and void insofar as it conflicts with them.

16. Copyright in advertisements produced wholly or partially by the Publishers belong to the Publishers. Advertisers may not reproduce such advertisements without the Publisher's consent.
